Poster Maker Terms of Service

"Poster Maker" adheres to the principle of "design without asking others, do it yourself easily" to provide you with high-quality services. In order to ensure that you can better use the Poster Maker platform and services, please be sure to carefully read and fully understand the contents of each clause, especially the exemption or limitation of liability and other clauses involving your major rights and interests. Your registration, login and use of this software shall be deemed that you have fully read and fully voluntarily accepted all contents of this user agreement, including any modification made by Poster Maker to this agreement at any time, and become a Poster Maker user. This agreement has legal effect between you and Poster Maker and becomes a legal document binding on both parties.

I. Service Description

1.Service Purpose: Design without asking others, do it yourself easily.

2.Service Subject: This service is provided to you by Poster Maker. "Poster Maker" is a network platform operated by Hangzhou Lemi Network Technology Co., Ltd. "Poster Maker" under this Agreement may refer to the Poster Maker mobile terminal and related technical services provided around the Poster Maker software product according to different contexts. "User" refers to the user who registers, logs in, and uses Poster Maker and services, and is more often referred to as "you" in this Agreement.

3.Service Content: Poster Maker is a multi-scenario commercial visual design platform that will provide you with including but not limited to various pictures, materials, templates, posters, logos, material management, etc.

4.Service Platform: Poster Maker provides this software or service including but not limited to Ios, Ipad, Android and other application versions, so that you can complete the design anytime, anywhere. Poster Maker will also continue to update and improve to meet your growing needs.

5.Service Target: Natural persons over the age of 18, legally existing legal entities, and legally existing non-legal organizations.

6.Scope of Service License: Poster Maker grants you a non-exclusive, non-transferable, non-sublicensable license to use the Software.

All other rights not expressly authorized in this Agreement remain reserved by Poster Maker, and you must obtain Poster Maker's written permission when exercising these rights. Poster Maker's failure to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right.

II. About "Account"

Account Registration

1.1 Before using Poster Maker's services, you can register through a third-party account approved by Poster Maker (such as WeChat account, email account, etc.). In order to ensure that the platform services you enjoy are safe, effective and continuously optimized, you agree to authorize Poster Maker to verify and reasonably use your personal information.

1.2 The account you successfully registered can only be used by the user confirmed when you registered. It should not be used for illegal purposes, should not be used to harm the interests of other parties, should not be maliciously registered in batches, should not be disclosed, lent, donated or transferred to others, etc. Otherwise, you must be responsible for improper use.

1.3 The same mobile phone number and the same third-party account can only be bound to one account.

1.4 You are responsible for the authenticity, accuracy and legality of the registration information you provide, and update your information in a timely manner. If you provide any illegal, immoral or Poster Maker information that Poster Maker deems inappropriate for display on Poster Maker, or Poster Maker has reason to suspect that your information is a program or malicious operation, Poster Maker has the right to suspend or terminate your account and refuse you to use all or any part of the Service now and in the future.

1.5 Poster Maker does not assume any responsibility for any registration information of any user, including but not limited to the responsibility of identifying and verifying the authenticity, correctness, completeness, applicability and/or whether any registration information is the latest information.

1.6 After you complete the registration of Poster Maker account, you have the right to use the account within the scope of Poster Maker's authorization, and the ownership belongs to Poster Maker. You are responsible for properly and correctly keeping, using and maintaining your member account (including account information and password), and taking necessary and effective confidentiality measures.

User Account Security

2.1 After completing the registration process for this service and successfully registering, you can use your mobile phone number and email address to log in to your account on Poster Maker. It is your responsibility to protect the security of your account.

2.2 You shall be fully responsible for all activities using your account, including but not limited to any data modification, payment, image design, etc. You shall attach great importance to the confidentiality of your account and shall not disclose your account to others under any circumstances. You shall immediately notify Poster Maker of any unauthorized use of your Poster Maker account or any other security issues.

If you fail to keep your account safe, Poster Maker cannot and does not assume any responsibility for any loss or damage caused by it.

You are responsible for maintaining the security and confidentiality of your account and assume full legal responsibility for the activities you engage in under the name of your registered account. If you fail to keep your account safe and cause damage to you, Poster Maker or a third party, you will be fully responsible.

2.3 To improve the security of your account, Poster Maker has adopted an advanced account security system to ensure that your account is not stolen.

III. User Information Protection and Authorization

1.You acknowledge and agree that, in order to facilitate your use of the services related to this platform, this platform will collect, use, store and share your personal information and necessary information in accordance with the provisions of this Agreement and the Privacy Policy, including but not limited to your data, drawing records, drawing results, etc. Without your permission, Poster Maker will not obtain, store or disclose or disclose your personal information to a third party, except as required by laws and regulations, the Privacy Policy or otherwise agreed.

2.Poster Maker will use various security technologies and procedures and establish a sound management system to protect your personal information and prevent your information from being improperly used or unauthorized access, use or disclosure.

3.Without your consent, Poster Maker will not disclose your personal information to any other company, organization or individual, unless:

(a) required by relevant laws and regulations or judicial or administrative authorities;

(b) transferred to complete mergers, divisions, acquisitions or asset transfers;

(c.) Necessary to provide the services you requested;

(d) transferred or disclosed to a third party in accordance with the Privacy Policy or other agreement rules.

IV. User Behavior Standards

Information Content Standards

You shall be responsible for the authenticity and legality of the information content published using the Poster Maker platform and services. If you need to obtain prior authorization or approval from the rights holder of the information content or any authorized third party, you should obtain such authorization or approval in advance;

Once you publish a certain information content, it will be deemed that you have obtained such authorization or approval in advance.

1.1 The information content referred to in this article refers to any content produced, downloaded, used, published, and disseminated by users using Poster Maker, including but not limited to the user's nickname, avatar, user description and other registration information, or the text, pictures, audio, video, etc. generated by you using Poster Maker, as well as other content generated by using Poster Maker.

1.2 You understand and agree that Poster Maker has been committed to providing users with a civilized, healthy, standardized and orderly network environment. You shall not use Poster Maker to Maker produces, copies, publishes, and disseminates any illegal or unlawful content, including but not limited to:

(a) Opposing the basic principles established by the Constitution;

(b) Endangering national security, leaking state secrets, subverting the state power, undermining national unity, and damaging national honor and interests;

(c.) Inciting ethnic hatred, ethnic discrimination, and undermining national unity;

(d) Undermining the state's religious policies, promoting cults and feudal superstitions;

(e) Spreading rumors, disrupting social order, and undermining social stability;

(f) Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crimes;

(g) Insulting or slandering others

(h) Contains false, fraudulent, harmful, coercive, invasive of others' privacy, harassment, infringement, slander, vulgar, obscene, or other morally objectionable content;

(i) Content that infringes others' privacy, personal information, copyright, trademark rights and other intellectual property rights or legal rights;

(j) Disseminates commercial advertisements for tobacco, alcohol, drugs, cosmetic surgery, and health care products, or similar commercial solicitation information, disseminates excessive marketing information and spam;

(k) Contains other content restricted or prohibited by Chinese laws, regulations, rules, ordinances, and any other legally binding regulations, or contains content that Poster Maker deems inappropriate for display.

1.3 You understand and agree that Poster Maker aims to launch diversified, multi-style, and multi-type fonts and materials for your use, but you still need to abide by legal regulations and website agreements during your experience.

1.3.1 If you use the images, templates, texts, posters and other content downloaded from the Poster Maker platform for advertising content, the following situations are prohibited:

(a) Use or disguise the national flag, national anthem, national emblem, military flag, military anthem, and military emblem of the People's Republic of China;

(b) Use or disguise the name or image of state organs or state organ staff;

(c.) Use terms such as "national level", "highest level", and "best";

(d) Other situations that are prohibited from being used for advertising according to laws and regulations.

1.3.2 If you use the images, templates, texts, posters and other content downloaded from the Poster Maker platform for trademarks, corporate names, product names or logos, etc., you shall not:

(a) Use or disguise the national flag, national anthem, national emblem, military flag, military song, military emblem, medal of the People's Republic of China, foreign countries or international intergovernmental organizations;

(b) Use or disguise the name, logo, name of a specific place of the central state organs or the name and graphics of landmark buildings;

(c) Use the place names of administrative divisions above the county level or foreign place names known to the public;

(d) Use the fonts and font libraries that Poster Maker or the font provider prohibits for use in this article;

(e) Other situations that are prohibited by laws and regulations from being used for the purposes of this article.

1.3.3 If the images provided by Poster Maker contain the national flag, national emblem, military flag, military emblem, etc., you are prohibited from damaging, defacing, scribbling or trampling in any way, otherwise you will be held legally liable.

1.3.4 If the templates provided by Poster Maker contain portraits of people, you may not use the portraits in the templates in an offensive or immoral manner, such as pornography, plastic surgery, defamation, or other illegal or immoral purposes.

1.3.5 Poster Maker will use the LOGO, brand logo, etc. of e-commerce platforms in e-commerce materials, posters, and templates to facilitate the use of e-commerce users. If you are not an e-commerce user of the e-commerce platform or you have not participated in the e-commerce activities corresponding to the LOGO and brand logo, you may not use the above materials, posters, and templates. If you must use them, you must delete the LOGO and brand logo, otherwise you will bear the responsibility and losses caused by them.

1.3.6 Without the written permission of Poster Maker, you may not register the pictures, templates, texts, LOGO, etc. on Poster Maker as trademarks or apply for design patents. If you need this, you can contact Poster Maker for exclusive customization or obtain special authorization.

Software Usage Guidelines

You agree to use Poster Maker in a reasonable and legal manner in accordance with the provisions of this Agreement. Unless permitted by law or with written permission from Poster Maker, any pictures and other content you view, share, download, use, disseminate, or publish through Poster Maker are for your personal use only. You may not transfer the user rights obtained under the terms of this Agreement for a fee or free of charge, and may not engage in the following acts:

(1) Use third-party software, plug-ins, external devices, systems, devices, etc. that are not provided or approved by Poster Maker to log in or use this service.

(2) Sell, rent, lend, copy, modify, link, reprint, compile, publish, commercially download, etc. the content with intellectual property rights owned by Poster Maker;

(3) Reverse engineer, disassemble, decompile the Software, or otherwise attempt to discover the source code of the Software;

(4) Intercept, tamper with, collect, store or delete other people's personal information, in-site emails or other data without legal authorization, or use such information for any illegal or improper purpose;

(5) Copy, modify, add, delete, mount or create any derivative works of the Software or the data released to any terminal memory during the operation of the Software, the interactive data between the client and the server during the operation of the Software, and the system data necessary for the operation of the Software, including but not limited to the use of plug-ins, external plug-ins or other data not authorized by Poster Maker. Maker authorized third-party tools/services to access this software and related systems;

(6) By modifying or forging the instructions and data in the software operation, adding, deleting, changing the functions or operating effects of the software, or operating or disseminating the software and methods used for the above purposes to the public, regardless of whether these behaviors are for commercial purposes;

(7) Log in or use the Poster Maker platform and services through third-party software, plug-ins, external plug-ins, systems that are not developed or authorized by Poster Maker, or produce, publish, and disseminate the above tools;

(8) Interfere with this software and its components, modules, and data by yourself or authorize others or third-party software;

(9) Use any means (including but not limited to third-party software, plug-ins, external plug-ins, systems, devices, etc.) to interfere with, destroy, modify or carry out any other activities that endanger network security;

(10) Other acts that violate laws, regulations, policies or are not expressly authorized by Poster Maker;

In addition to the provisions of this Agreement, Poster Maker will also remind users in various forms on the service platform to use the services provided by Poster Maker in a standardized manner, and you must comply. You acknowledge that Poster Maker does not fully control the user's use behavior. When you use any content, including relying on the correctness, completeness or legality of the aforementioned content, you agree to make your own judgment and bear all risks. Poster Maker is not responsible for any loss or damage caused by the aforementioned risks to the extent permitted by law. In any case, if Poster Maker has reason to believe that any of your actions violates or may violate the above agreement, Poster Maker can independently judge and deal with it, and has the right to terminate the service to you without notice and pursue relevant responsibilities. If you violate the agreement of this agreement and use the services provided by Poster Maker and are held accountable by a third party, you will bear all the responsibility.

V. Breach of Contract

If the administrative agency or Poster Maker discovers or receives reports from others that you have violated this Agreement or have committed any malicious acts, Poster Maker has the right to delete or block relevant content (including but not limited to works, finished designs, etc.) at any time without notice, and impose penalties on the violating accounts, including but not limited to warnings, restrictions or prohibitions on the use of all or part of the functions, account bans, cancellations, etc., depending on the circumstances of the behavior, and announce the results of the handling. Poster Maker has the right to keep relevant records of suspected violations of laws and regulations and suspected crimes, and report to the relevant competent authorities and cooperate with the relevant competent authorities in investigations in accordance with the law. Poster Maker has the right not to restore the deleted content and does not assume any liability for breach of contract, and the resulting losses shall be borne by you.

If you violate this Agreement or other terms and conditions and cause complaints or lawsuits from third parties, you shall bear all legal responsibilities. If Poster Maker and its affiliates compensate any third party or suffer penalties from state agencies due to your illegal or breach of contract behavior, you shall also fully compensate Poster Maker and its affiliates for all losses suffered as a result.

The company respects and protects the intellectual property rights, reputation rights, name rights, privacy rights and other legal rights of legal persons and citizens. You guarantee that the text, video, audio, link, etc. uploaded by Poster Maker do not infringe any third party's intellectual property rights, reputation rights, name rights, privacy rights and other legal rights. Otherwise, Poster Maker has the right to remove the suspected infringing content upon receiving a notice from the right holder or relevant party. You shall bear all legal responsibilities for all claims made by third parties; if your infringement causes losses to Poster Maker and its affiliates (including but not limited to economic and goodwill losses), you shall also fully compensate Poster Maker and its affiliates for all losses suffered.

VI. Interruption and Termination of Service

1.You understand and agree that Poster Maker has the right to temporarily or permanently modify or terminate the Service (or any part thereof) at any time, with or without notice. You agree that Poster Maker shall not be liable to you or any third party for any modification, suspension or termination of the Service, and you shall properly update, backup and transfer data.

2.Due to your violation of this Agreement, Poster Maker has the right to interrupt or terminate one or more of the Services according to the actual situation. In case of serious violation, Poster Maker will directly terminate your right to use Poster Maker.

3.If you have objections to the contents of this Agreement or are dissatisfied with the services provided by Poster Maker, you may exercise the following rights:

(a) Stop using the Poster Maker account service;

(b) Cancel your account by yourself or notify Poster Maker to cancel your account. Account cancellation will result in the deletion of your personal information, drawing records, design details, etc. on Poster Maker, and the corresponding rights and obligations between you and Poster Maker will be terminated (your any obligation to compensate for damages will not be terminated as a result). Poster Maker is not responsible for sending any unprocessed information or unfinished services to you.

VII. Third-party products and services

1.When you use products or services provided by a third party in this software, in addition to complying with the provisions of this Agreement, you must also comply with the third party's user agreement. Any disputes arising from your use of products or services provided by a third party shall be resolved by you and the third party, and Poster Maker shall not bear any responsibility.

2.When you use products or services provided by a third party in this software, this software may call a third-party system or support user use or access through a third party. The results of use or access are provided by the third party. Poster Maker does not guarantee the security, accuracy, effectiveness and other uncertain risks of the services and content provided by third parties. Any disputes and damages caused by this have nothing to do with Poster Maker, and Poster Maker does not bear any responsibility.

VIII. Advertisements

1.Poster Maker may contain advertisements, which is a reasonable and legal business model of Poster Maker and its affiliates. You agree to receive advertising information or other information (including commercial and non-commercial information) published by Poster Maker, its affiliates or its third-party partners during the use of Poster Maker. The specific form, frequency and content of the information sent and displayed shall be subject to the actual provision of Poster Maker.

2.Any communication or business dealings you have with advertisers and other third parties through this website, or participation in promotional activities, including payment and delivery of related goods or services, and any other relevant terms, conditions, warranties or statements reached, are entirely between you and advertisers and other third parties. You shall judge the authenticity of the advertising information on your own and be responsible for your own judgment and behavior. Except as expressly provided by law, Poster Maker shall not bear any legal responsibility for any loss or damage of any nature suffered by you due to any of the aforementioned transactions or the aforementioned advertisers and other third parties.

IX. Value-added Services

1.Poster Maker may charge for some services, or adopt a paid model in the future, and adjust and improve the charging standards and methods of the paid model according to actual needs. If you use paid services, please abide by the relevant agreements. If you do not agree to the relevant agreements and their modifications and changes or you are under 18 years old, please suspend the use of value-added services.

2.When Poster Maker reduces the charging standards for value-added services or changes paid services to free services, Poster Maker reserves the right not to provide refunds or fee adjustments to original paying users.

3.According to changes in the market environment and technological development, Poster Maker may open some new features or adjust some existing features from time to time.

X. Disclaimer

1.You understand and agree that Poster Maker software and related services may be affected or interfered by a variety of factors, so Poster Maker does not guarantee (including but not limited to):

(a) fully suitable for user requirements;

(b) uninterrupted, timely, safe, reliable or error-free; any software, services or other materials obtained by users through Poster Maker meet the user's expectations;

(c) any errors in the software will be corrected.

2.Please be cautious and make your own judgment on network information, account passwords, advertisements or promotions involving borrowing or other property-related information. Based on the above reasons, the company does not assume any direct, indirect, incidental, special, derivative or punitive liability for the loss of profits, business reputation, data or other tangible or intangible losses you suffer as a result.

3.You understand and agree that in the use of Poster Maker, you may encounter factors such as force majeure (force majeure refers to objective events that cannot be foreseen, overcome or avoided), including but not limited to government actions, natural disasters, network reasons, hacker attacks, wars or any other similar events. In the event of force majeure, the company will strive to repair it in time, but the user agrees that the company will not be responsible for the loss caused to the user due to force majeure.

4.Poster Maker will obtain the right to deal with illegal and illegal content in accordance with the provisions of this agreement. This right does not constitute the company's obligation or commitment. The company cannot guarantee timely discovery of illegal acts or corresponding treatment.

5.You clearly understand and agree that: Regarding the services of this agreement, Poster Maker does not provide any kind of express or implied warranty or condition, including but not limited to commercial merchantability, fitness for a particular purpose, etc. You must bear the corresponding risks for your use of the software and related services of this agreement.

6.You clearly understand and agree that the risks of your use of this service are borne by you personally, including but not limited to any damage to your mobile phone or data loss caused by the download of any information; you upload text, information, data, photos, graphics, information or other personal data to the Internet, and it is copied, reproduced, or used for other purposes by other organizations or individuals.

7.You clearly understand and agree that this service is only provided based on its current status. Poster Maker does not assume any responsibility for the timeliness, deletion, transmission error, non-storage or any other problems of any user information or personalized settings. Poster Maker reserves the right to suspend any part of this service for maintenance, upgrade or other purposes without prior notice.

8.You clearly understand and agree that this agreement is to ensure compliance with national laws and regulations, maintain public order and good customs, and protect the legitimate rights and interests of others. Poster Maker will make its best efforts to make judgments in accordance with relevant laws and regulations within its capabilities, but it does not guarantee that the company's judgment is completely consistent with the judgment of judicial and administrative agencies. If the consequences arise, the user has understood and agreed to bear them.

Ⅺ. Limited Liability of Poster Maker

You use the content provided by Poster Maker strictly in accordance with the provisions of this Agreement and do not violate any other agreements signed with Poster Maker. If you are accused of copyright infringement by a third party, Poster Maker will provide you with necessary legal assistance. If you bear liability for compensation or other adverse legal consequences, you have the right to apply to Poster Maker for compensation for the direct losses you suffer (excluding loss of potential profits) within the compensation amount agreed in this Agreement. The maximum limit of Poster Maker's legal liability caused by the content is: within the scope permitted by law, ten (10) times the fees you pay to Poster Maker (such as membership fees). If you continue to use the content after Poster Maker notifies you or you learn that any content is accused of infringing the rights of a third party, this compensation guarantee does not apply.

You clearly understand and agree that Poster Maker cannot review and track the purpose of your use of the above content. Accordingly, if you use the content beyond the scope of this Agreement or other scope authorized by Poster Maker, the resulting third-party liability or your own losses will be borne by you.

Ⅻ. Intellectual Property Statement

Poster Maker is the intellectual property rights holder of this software and services. All copyrights, patents, trademarks, trade secrets and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, pictures, audio, video, interface design, layout framework, electronic documents, etc.) are protected by the People's Republic of China and relevant international treaties. Poster Maker enjoys the above intellectual property rights, except those that belong to others according to law.

Without the written consent of Poster Maker, you may not implement, use or transfer the above intellectual property rights by yourself or authorize a third party for any commercial or non-commercial purpose. Poster Maker reserves the right to pursue legal liability for the above actions.

You understand and agree that the text, pictures, audio, etc. that you upload and publish when using the Poster Maker platform and related services are original or legally authorized (including sublicense). The intellectual property rights of the content you create through Poster Maker belong to you or the original copyright owner.

You agree to grant Poster Maker a free, non-exclusive right to collect, use, store, manage and protect the user content you generate in the process of this service worldwide for the purpose of providing, optimizing and promoting this service. Poster Maker will use User Content within a reasonable scope in accordance with the Privacy Policy and make every effort. Your necessary authorization and consent does not necessarily mean that Poster Maker will use the content you generate during the service, nor does it change your ownership of User Content and its intellectual property rights, nor does it affect any legal use of your User Content.

XIII. Complaint Methods and Handling

1.If you find any content infringing your rights on the Poster Maker platform (including but not limited to "data security, telecommunications fraud, work violations (including pornography, vulgarity, political sensitivity, spam advertising, etc.), infringement"), please immediately notify Poster Maker via email support@lovewith.me or provide preliminary evidence of your relevant rights through "Help and Feedback". Poster Maker will handle your complaint in a timely manner in accordance with legal provisions. If you are complained of infringement by the relevant rights holder for using the content produced by Poster Maker, you can also file a counter-notice and relevant rights certification materials to support@lovewith.me to file a complaint. The company will also handle your complaint in a timely manner in accordance with legal provisions.

2.Poster Maker advocates that you participate in the maintenance and supervision of the compliance and cleanliness of the Poster Maker use environment. Whether Poster Maker proactively discovers your improper or illegal behavior, or Poster Maker preliminarily verifies your improper or illegal behavior based on reports and complaints, Poster Maker has the right to immediately take necessary measures without prior notice to stop the continuation of such behavior.

XIV. Other Terms

1.Your login and use of Poster Maker shall be deemed that you have read and agreed to be bound by this Agreement.

2.Poster Maker has the right to modify this Agreement in accordance with changes in national policies, technical conditions, product functions, etc., and publish the modified Agreement. You can view more relevant agreement terms in the latest version of Poster Maker. After the terms of this Agreement are changed, if you continue to use Poster Maker, it is deemed that you have accepted the modified Agreement.

3.The content of this Agreement also includes relevant agreements, rules, etc. (including the Privacy Policy) that Poster Maker has published and may continue to publish in the future. The aforementioned content has been published, and the company will remind you to read it in a timely manner in an appropriate manner (website announcement, system notification, etc.). The aforementioned relevant agreements and rules constitute an integral part of this Agreement, and you should also comply with them.

Unless otherwise expressly provided in this Agreement, Poster Maker's addition or enhancement of any new functions currently available, including new products launched, shall be subject to the regulations of this User Agreement.

4.The establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be subject to the laws of the People's Republic of China.

5.This Agreement is signed in Binjiang District, Hangzhou City, People's Republic of China. If you have a dispute with Poster Maker, you should try to resolve it through friendly negotiation. If the negotiation fails, you agree to submit the dispute to the People's Court of the domicile of Hangzhou Lemi Network Technology Co., Ltd.

6.The titles of this Agreement and all clauses are for convenience only and have no legal or contractual effect.

Poster Maker can send you all notifications through web page announcements, emails, mobile phone text messages or regular mail transmission (the contact information is subject to the one you reserved on the platform); such notifications are deemed to have been delivered to the recipient on the date of sending.
